To make sure this is a mutually beneficially relationship for both parties, we have put together some guidelines to make ensure continued harmonic interactions.

Therefore we ask that you our client, adhere to our regulatory measures we have in place. They are there for you guidance in striving to avoid illegal or damaging behaviour on the Internet.

Clients are required to follow standard ethical guidelines for their web site(s), including:

Spam:

Unauthorised sending of emails to newsgroup is strictly prohibited if referencing to or using a website hosted on our servers. If found doing so, your accounts can be suspended or banned from the OFS Hosting community.

Child Pornography:

The use of the Services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. OFS Hosting will notify authorities in such cases that we become aware that our sites are being used to store, transmit, or trade such material.

Adult material or sites that contain hyperlinks directing users to any pornographic websites will be removed and no longer hosted through OFS Hosting or our servers. Also, sites that participate in illegal activities such as trafficking in obscene materials, drugs, or other topics prohibited under Federal Law will be shut down at once, and proper legal action will be taken.

Fraud:

Sites that purposely encourage fraudulent activity, or serve to defraud users on the Internet will be in violation of our terms of service, and will be shut down. Likewise, sites that serve to impersonate or forge the identity of others will be in violation of our conditions for use.

Security:

Sites infringing on the security systems of others or found to have purposely sent damaging viruses or worms will be immediately removed from our servers.

Hacking:

Sites that promote or exchange this kind of information or other subject matter related to hostile hacking capabilities will be instantly removed from our servers. IRC hacking/etc.

Age of Consent:

Clients must be of legal age of consent to enter into this agreement with OFS Hosting for any of our paid services. Legal age of consent is considered 18 years of age.

MP3:

At this time we do now allow the uploading of legal mp3s files to our Real Media servers. Sites that upload illegal MP3's or are found to contain these will be asked to have them removed.

Miscellaneous:

Sites that encourage illegal or racist activity are in direct violation of our terms and will result in immediate removal from our servers. Defamation, threatening or posting of private information without consent is strictly prohibited.

Passwords and Security:

All customers are solely responsible for the safe storage and access to passwords and other logins. OFS Hosting keeps your information secure, we ask that you do the same.

Each account comes with a control panel that allows each customer to make backup copies of crucial account information. It is imperative that each customer takes the initiative to ensure their files are backed up as much as they see fit. It is solely your responsibility to maintain local copies of your website content and any information on your account(s) including but not limited to website, email, databases, mailing lists, and archives. The "CPanel Control" has easy account backup program included A weekly back up is good practice. If loss of data occurs due to an error of OFS Hosting error we will attempt to recover any data lost free of charge.

We do maintain a guaranteed up time of 99.9%

Bandwidth:

Customers agree that if they are outside of their monthly bandwidth usage on any plans they will be billed in excess of that. Customers will be billed 1.50 per GB exceeding bandwidth usage. The CPanel control lets you easily monitor your monthly banwidth usage.

Protected information legally belongs solely to the holder of the copyright and should therefore not to be used without express permission from the owner.

From time to time OFS Hosting will make changes to the policy, to better suit our customers, and as per business needs. In cases where customers are going to be directly affected. OFS Hosting will make every attempt to contact customers directly. Otherwise we reserve the right to make changes to our policies at any time to suit changing technologies and new laws. Changes will be made to the policy without direct contact in such cases.

We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law. You agree to use all OFS Hosting services and facilities at your own risk. OFS Hosting specifically disclaims all warranties of merchantability and fitness for a particular purpose.

In no event shall OFS Hosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold OFS Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against OFS Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns.
